Pantastic Networks Privacy Notice

Thank you for your interest in Pantastic Networks! Pantastic Networks is the provider of e-commerce services to independent retailers through specific SaaS applications (such retailers using the SaaS applications, collectively, the “Brands”). This Privacy Notice explains how RetailerX, Inc. (d/b/a Pantastic Networks) and its subsidiaries and affiliated companies (collectively, “Pantastic Networks”) collect, use, disclose, and otherwise processes personal information in connection with our websites, including pantastic.com and other websites we own and operate that link to this Privacy Notice (the “Sites”), and the related content, platform, services, products, and other functionality offered on or through our Services.

When we use the terms “Pantastic Networks”, “we”, “us”, or “our” in this Privacy Notice, we are referring to Pantastic Networks. When we use the term “Service,” we are referring to all of the services that we offer, including our product offerings and related platforms, affiliate marketplaces and related services, and the websites and mobile applications, if any, that post or link to this Privacy Notice.  Note that our Services are also subject to our Terms of Service.

In some instances, as part of our services to Brands (such as customers of UpOrder, CodeGenius, Refersion or other e-commerce tools), we may conduct data processing activities on information relating to the Brands’ end users (“Brand Data”). In such instances, we have contractually committed ourselves to only process Brand Data on behalf of and under the instruction of the respective Brand, who is the “data controller”. This Privacy Notice does not apply to such processing and we recommend you read the privacy notice of the respective Brand if their processing concerns your personal information.

Our Collection of Personal Information

From the first moment you interact with us, we are collecting personal information about you. Sometimes we collect personal information automatically when you interact with our Services and sometimes we collect the personal information directly from you. At times, we may collect personal information about you from other sources and third parties, even before our first direct interaction.

We use commercially reasonable methods of protecting your personal information. Nevertheless, we cannot guarantee the safety or security of any personal information. Further, transmission of personal information cannot be made completely secure. For that reason, you agree to transmit personal information to us solely at your own risk. If you believe your personal information is being improperly used by us or any third party, please immediately notify us via email at compliance@pantastic.com.

Personal Information You Provide

The personal information that we collect from you is dependent on the way in which you interact with our Services.

Information for Visitors of Pantastic.com

When you interact with pantastic.com or any related service sites, including uporder.com, refersion.com or the like (all referred to herein as “pantastic.com”), we may collect the following personal information you provide in connection with our Service:

-   Contact Information: We may collect your contact information, including your full name, email address, mailing address and telephone number.

-   Account Identifiers: When you register for an account, we collect certain information including your email address and password.  We may assign internal identifiers to your account to allow our systems to connect account information stored in different databases and tables. We may also collect your Contact Information and month and day of birth.

-   Customer Service and Communication History:  When you contact us through any method of communications, including through our Service (such as the “Submit a request” link), via email, or through our chat bot, we may collect certain information including your name, address, email, Account Identifiers, Account History and the contents of your requests and your correspondence with us.

-   Newsletters and Email Communication:  Our Service provides you an opportunity to sign up for our email communications by providing your email address.  We use your email address to communicate with you about our services and developments at Pantastic, which may include marketing communications.  Please see the Your Communication Preferences section below for additional information about opting out of our marketing communications.

-   Feedback Information:  We may also collect feedback and ratings you provide relating to our services, products and rewards, including reviews of products which may appear on our website.

Although we often collect the personal information described above directly from you, we also collect this information through service providers and other third parties that collect it on our behalf, such as communications providers, analytics providers, and marketing providers.  In addition to the foregoing, we may make use of information provided by you or information regarding your interactions with pantastic.com and its Brands in an anonymized format.  Such anonymized information may be used by Pantastic for any purpose. Please see the Personal Information from Other Sources and Third Parties section below.

Information for Brands

If you are a Brand and use any of the SaaS services provided by Pantastic Networks, we may collect the following personal information you provide in connection with our Service:

-   Contact Information: When you communicate with us or purchase one of our Services, we may collect your contact information, including your full name, email address, mailing address, telephone number, company name and title.  

-   Account Identifiers: When you register for an account, we collect information, including a username and password.  We may assign internal identifiers to your account to allow our systems to connect account information stored in different databases and tables.

-   Transaction Information: When you purchase one of our SaaS Services, such as Refersion, UpOrder, or CodeGenius, we collect information needed to complete your transaction, including your Contact Information, billing address, shipping address, email address, and phone number.  We may track individuals interacting with your Shopify store and may also collect the transaction description, order number, date, time and location of purchase/transaction, services purchased, sale amount, and discount amount in connection with transactions occurring within the applicable Shopify store. Please note that we use third-party payment processors, such as Shopify and Stripe, to process payments made to us. (Such services are subject to the relevant service providers’ terms of service and privacy policies.) As such, we do not retain any personally identifiable financial information in connection with your payment, such as credit card numbers. Rather, all such information is provided directly by you to Shopify. Shopify’s use of your personal information is governed by their privacy notice. -   Customer Service and Communication History:  When you contact us through any method of communications, including through our Service or via email, we collect certain information including your name, address, email, proof of purchase, Account Identifiers, Account History and the contents of your requests and your correspondence with us.

-   Newsletters and Email Communication:  We may use your email address to communicate with you about our services, product updates and exciting developments at Pantastic Networks, which may include marketing communications.  Please see the Your Communication Preferences section below for additional information about opting out of our marketing communications.

-   Feedback Information:  we may collect information you provide, including feedback and ratings you provide relating to our Service.

Information for Refersion Affiliates

If you are an individual or business who is registered with the Service as an affiliate of a Brand using Refersion, we may collect the following personal information you provide in connection with our Service:

-   Contact Information: When you communicate with us or purchase one of our Services, we may collect your contact information, including your full name, email address, mailing address, telephone number, company name and title.  

-   Account Identifiers: When you register for an account, we collect information, including a username and password.  We may assign internal identifiers to your account to allow our systems to connect account information stored in different databases and tables.

-   Customer Service and Communication History:  When you contact us through any method of communications, including through our Service or via email, we collect certain information including your name, address, email, proof of purchase, Account Identifiers, Account History and the contents of your requests and your correspondence with us.

-   Newsletters and Email Communication:  We may use your email address to communicate with you about our services, product updates and exciting developments at Pantastic Networks, which may include marketing communications.  Please see the Your Communication Preferences section below for additional information about opting out of our marketing communications.

-   Affiliate Opportunities: If you are an affiliate that has opted-in to participate in the Refersion Affiliate Marketplace, we may communicate with you about new service offerings, about Brands that offer affiliate programs that may be of interest to you and other developments, which may include marketing communications.  We may also share information that you have provided to us regarding your preferences, audience and other information included in your affiliate profile.  This information may be shared with Brands using the Refersion Service that may be interested in working with you.  Please see the Your Communication Preferences section below for additional information about opting out of our marketing communications.

-   Feedback Information:  we may collect information you provide, including feedback and ratings you provide relating to our Service.

Although we often collect the personal information described above directly from you, we also collect this information through merchants who interact with you, service providers and other third parties that collect it on our behalf, such as communications providers, analytics providers, and marketing providers.  In addition to the foregoing, we may make use of information provided by affiliates in an anonymized format.

Personal Information from Other Sources and Third Parties

As noted above, we may collect this personal information about you through service providers and other third parties that collect it on our behalf, as noted below. Please note that such service providers may record personal information that you type into websites and other online services even if you do not choose to submit it.

Information for Visitors of Pantastic.com

-   Referrals:  We may offer a referral service that allows you to tell one of your friends about our services by forwarding certain marketing communications and/or emails to an individual you believe may be interested in our products and services.  We use personal information collected in connection with these referral services to communicate with the individual you are referring and to provide you any benefits, incentives and/or rewards you may be eligible for as a result of your referral.

-   Single Sign-On: We may use single sign-on ("SSO") to allow you to login in and create an account using one set of login information, including through Google and Shopify. We will have access to certain information from those third parties in accordance with the authorization procedures determined by those third parties, which may include, for example, your name, username, email address, language preference, and profile picture. We use this information to operate, maintain, and provide to you the features and functionality of the Service.  We may also send you service-related emails or messages (e.g., account verification, purchase confirmation, customer support, changes, or updates to features of the Sites, technical and security notices).  

-   Social Media:  If you choose to interact with us on social media, we may collect personal information about you from your social media account that you make public.  We use personal information collected in connection with your social media account to communicate with you, better understand your interests and preferences, and better understand our customer base in the aggregate.  We may share this information with our marketing partners in connection with marketing and advertising activities.

-   Business Partners and Brands:  Our business partners, Brands, and other stakeholders collect personal information in connection with our Service and often share some or all of this information with us.  For example, we may receive information from Brands about transactions you complete on a Brand's page, or from a Business Partner in order to manage any rewards or other loyalty programs that may be in place from time to time.

-   Service Providers:  Our service providers, such as payment processors and marketing providers, collect personal information and often share some or all of this information with us.  For example, we receive personal information from payment processors to confirm that your payment for the services was accepted.  Such services are subject to the relevant service providers’ terms of service and privacy policies.

-   Information from Other Sources:  We may obtain information from other sources, including through third-party information providers, or through transactions such as mergers and acquisitions. We may combine this information with other information we collect from or about you. In these cases, our Privacy Notice governs the handling of the combined personal information. We use this information to operate, maintain, and provide to you the features and functionality of the Service, as well as to communicate directly with you, such as to send you email messages about products and services that may be of interest to you.

Information for Brands

-   Integrated Services: Through the provision of the Service, as a Brand, you may be given the option to access, connect or register for certain services, such as a Shopify Account, through the use of your user name and passwords (each, an “Integrated Service”), or otherwise have the option to authorize an Integrated Service to provide Personal Information or other information to us. By authorizing us to connect with an Integrated Service, you authorize us to access and store your name, email address(es), current city, profile picture URL, and other information that the Integrated Service makes available to us such as customer, order and product data, and to use and disclose it in accordance with this Privacy Notice. You should check your authorization settings on each Integrated Service to understand what information that Integrated Service makes available to us and make changes as appropriate. Please review each Integrated Service’s terms of use and privacy policies carefully before using their services and connecting to our Service.

-   Social Media:  If you choose to interact with us on social media, we may collect personal information about you from your social media account that you make public.  We use personal information collected in connection with your social media account to communicate with you, better understand your interests and preferences, and better understand our customer base in the aggregate.

-   Service Providers:  Our service providers, such as payment processors and marketing providers, collect personal information and often share some or all of this information with us.  For example, we receive personal information from payment processors to confirm that your payment for the services was accepted.  Such services are subject to the relevant service providers’ terms of service and privacy policies.

Personal Information Automatically Collected

As is true of most digital platforms, we and our third-party providers and partners collect certain personal information automatically when you visit or interact with our websites and other online services:

-   Log Data:  Including your internet protocol (IP) address, operating system, browser type, browser ID, the URL you entered and the referring page/campaign, date/time of your visit, the time you spent on our services and any errors that may occur during your visit to our services.

-   Analytics Data:  Including the electronic path you take to our services, through our services and when exiting our services, as well as your usage and activity on our services, such as the links, objects, products and benefits you view, click or otherwise interact with (also known as Clickstream Data).  For instance, we may collect information related to your account history, including your purchase history, the date and type of enrollment and/or account creation, account status, log in activity, account transactions and benefits, the services we provide to you, the rewards you earn in connection with our services, the alert messages you receive in connection with the services, enrollment and account errors, and the cancellation date if you choose to cancel your services.

-   Location Data:  Including your general geographic location based on the Log Data we collect or more precise location when permitted by law.

-   Application Data:  Some of our services offer mobile or browser applications to allow you to take advantage of our service offerings on the go and/or when visiting third-party websites and other online services.  Certain of these applications also allow us to access more precise Location Data about you and collect information about your use and interactions with third-party websites and online services (including the products or services you are interested in or purchase) to better serve you.  Additionally, Brands may enable or authorize information to be shared via third-party tools or social networking sites.  Any such sharing is subject, in addition, to the terms of service and privacy policy of such third-party tools and social networking sites.  Such users should carefully and independently review such terms of service and privacy policies.  

Please note that our systems may record personal information that you type into our websites and other online services even if you do not choose to submit it.

Our Use of Personal Information

We use the personal information we collect through our websites and other online services to:

-   Provide our Service, including process payments, utilize benefits and incentives and make service requests;

-   Administer, audit, optimize and improve our Service, including test different configurations of our Service, diagnose errors and problems with our Service;

-   Remember you and the choices you have made in relation to our Service;

-   Provide you with news about products and services we or our preferred partners offer and deliver marketing communications and advertisements based on your interests and interactions with us.

-   Incorporate ideas from your responses into our business operations and customer service models;

-   Respond to your comments and questions and provide customer service.

-   Communicate with you regarding our services, offerings, products and rewards (including by sending you emails and SMS text messages);

-   Facilitate our day-to-day business operations, such as maintaining accounts and processing transactions;

-   Develop new products and services, and improve existing products and services;

-   Aggregate information we receive from you and third parties to help understand your needs, customize our services and offerings to you, and provide you better service;

-   Conduct research and analytics designed to understand our customer base and improve our products, services and customer experience;

-   Prevent, investigate or provide notice of fraud or unlawful or criminal activity;

-   Enhance security, monitor and verify identity or service access, combat fraud, spam, malware or other network and/or information security risks;

-   Detect bugs, report errors and perform activities to maintain the quality or safety of our services;

-   Understand you and your preferences to enhance and personalize your experience;

-   Personalize ads and display and measure engagement with advertisements across different devices and sites (for more information, see Targeted Advertising below);

-   Enforce and carry out contracts and agreements; and

-   Comply with legal obligations.

Please note that we link the personal information we collect in connection with the Service with the other personal information that we collect about you (including Clickstream Data and other similar information)  and may use it for the purposes we describe in more detail in the other sections of this Privacy Notice.  We may treat you as a single user of these combined services and products.  

Our Disclosure of Personal Information

We disclose personal information in the following ways:

-   Within Pantastic Networks:  We are able to offer you the products and services we make available because of the hard work of the entire Pantastic Networks team.  Pantastic Networks entities disclose personal information to other Pantastic Networks entities for purposes and uses that are consistent with this Privacy Notice.

-   Business Partners and Brands:   We may disclose personal information to our business partners, Brands, and other stakeholders for transactional and marketing purposes, including to promote their products or services.  For example, we may also share information that affiliates have provided to us regarding preferences, audience and other information included in an affiliate profile and may share that information with Brands using the Refersion Service that may be interested in working with you. We may also disclose personal information to Brands we partner with to support their commercial activities, or to business partners to provide events, contests, sweepstakes, or referral programs in which you choose to participate.

-   Data Analytics Providers:  We share personal information with data analytics providers who analyze statistics and trends relating to the usage of and activity relating to our services.  These data analytics providers produce reports and make suggestions for our customer and business strategy based on the personal information and other information analyzed.

-   Payment Processors and Online Payment Systems:  We share personal information with payment processors, online payment system providers and other billing agents to process your payment for the services and products you order, as well as to provide refunds. As described above in the relevant Transaction Information section, Pantastic Networks does not process personally identifiable financial information.  All such information is collected directly by the payment processors and are subject to their respective terms of service and privacy policies.

-   Marketing Partners:  We coordinate and share personal information with our marketing partners, including advertising networks, social networks, re-targeting partners and marketing communication providers, in order to communicate with you about our products and services and market our products and services to you.

-   Other Service Providers:  In addition to the third parties identified above, we engage other third parties to perform certain functions on our behalf in connection with the uses of personal information described in the Our Collection of Personal Information and Our Use of Personal Information section above, including rewards tracking, communication printing, website hosting, information technology support, content development and fraud monitoring.  Depending on the function the third party serves, the service provider may process personal information on our behalf or have access to personal information while performing functions on our behalf. -   Business Transaction or Reorganization:  We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company assets.  We may disclose personal information to a third party during negotiation of, in connection with or as an asset in such a corporate business transaction.  Personal information may also be disclosed in the event of insolvency, bankruptcy, or receivership.  Personal information that is disclosed in connection with any merger, acquisition, joint venture or financing or sale of company assets may be retained by Pantastic following such transaction for any of the purposes set forth in this privacy policy.

-   Legal Obligations and Rights:  We may disclose personal information to third parties, such as legal advisors and law enforcement:

o   In connection with the establishment, exercise, or defense of legal claims;

o   To comply with laws and regulations or to respond to lawful requests and legal process;

o   To protect our rights and property and the rights and property of our agents, customers, and others, including to enforce our agreements, policies, and terms of use;

o   To detect, suppress, or prevent fraud;

o   To reduce credit risk and collect debts owed to us;

o   To protect the health and safety of us, our customers, or any person; or

o   As otherwise required by applicable law.

-   Consent:  We may disclose personal information about you to certain other third parties with your consent.

Targeted Advertising

We may engage certain third-party service providers to serve advertisements on our behalf across the Internet and to provide analytics services.

Our advertisers or the ad networks that serve advertisements may utilize cookies or other similar tracking technologies (including within the ads) to collect anonymous device information and Clickstream Data. This information may be used by us, our service providers and their clients in aggregated, anonymous form to, among other things, analyze and track aggregated data, determine the popularity of certain content or products, measure the effectiveness of ad campaigns, determine the proper amount of repeat views of a given ad, and deliver advertising and content targeted to your interests on our Services and outside of our Services on other websites (also known as “interest-based advertising”).

Your Communication Preferences

In connection with our services, we may send you email messages, push notifications or other communications, including telephone calls, regarding our services.  You may ask us not to send you marketing communications or request a change to the method or frequency of communication by:

We make every effort to promptly process all opt-out requests, but please allow up to 10 days for your request to be processed.  If you request to opt out of marketing communications, please note that we may continue to send you non-marketing communications, such as those directly related to the fulfillment of a specific transaction you requested, maintenance of your account or status of our ongoing business relations.

Privacy Choices

Personal Information Rights.  Certain jurisdictions grant individuals rights in relation to the personal information collected and processed about them.  Depending on your state of residency and applicable law, you may be able to request to exercise the following rights in relation to the personal information we maintain about you:

Know The right to request confirmation regarding whether we process personal information about you and certain details about the personal information we may process.
Access & Portability The right to request access to and obtain a copy of personal information we maintain about you, including a copy of the data in an easily accessible format that you can transmit to a third party.
Correction The right to request that we correct or update any personal information about you that is inaccurate or incomplete.
Restriction of Processing The right to request that we limit the purposes for which we process your personal information, including to restrict our ability to sell your personal information, conduct cross-context behavioral advertising, or continue to process your personal information if such continued processing is not justified, such as where the accuracy of the personal information is contested by you.
Objection to Processing The right to object to our processing of your personal information, such as where we are processing your personal information for marketing purposes or where you believe there is no compelling and legitimate interest for the processing.
Deletion The right to request the deletion or erasure of personal information about you. Please note we may need to close your account with us in order to fully delete your personal information.
Non-Retaliation The right not to receive retaliatory or discriminatory treatment for exercising any of the rights described above.

To submit a request, please contact us at compliance@pantastic.com specifying your location and the right you are seeking to exercise.  We may need to verify your identity before processing your request, which may require us to obtain additional personal information from you.  

Withdrawal of Consent. Where we rely on your consent for processing of your personal information, you may be able to withdraw your consent to such processing, subject to certain limitations at law. Please contact us at compliance@pantastic.com if you would like to withdraw your consent from certain specific processing of your personal information. 

Children’s Personal Information

Our websites and online services are not directed to, and we do not intend to, or knowingly, collect or solicit personal information from children under the age of 13.  If you are under the age of 13, please do not use our websites or online services or otherwise provide us with any personal information either directly or by other means.  If a child under the age of 13 has provided personal information to us, we encourage the child’s parent or guardian to contact us to request that we remove the personal information from our systems.  If we learn that any personal information we collect has been provided by a child under the age of 13, we will promptly delete that personal information.

Third-Party Websites

Our websites and online services may include links to or redirect you to third-party websites, plug-ins and applications, including social media services where you may connect with us.  Third-party websites may also reference or link to our websites and online services.  Except where we post, link to or expressly adopt or refer to this Privacy Notice, this Privacy Notice does not apply to, and we are not responsible for, any personal information practices of third-party websites and online services or the practices of other third parties.  To learn about the personal information practices of third parties, please visit their respective privacy notices or policies.

Updates to This Privacy Notice

We will update this Privacy Notice from time to time.  When we make changes to this Privacy Notice, we will change the “Last Updated” date at the beginning of this Privacy Notice.  If we make material changes to this Privacy Notice, we will notify you by prominent posting at the beginning of this Privacy Notice.  Any changes to the Privacy Notice shall be effective upon posting of the updated Privacy Notice.
